1. Acceptance of these Terms and Conditions
Your access to and use of https://www.stemeditor.com (the “Website”) and any order for proofreading or editing services is subject exclusively to these Terms and Conditions. By using the Website or placing an order you fully accept these terms, conditions and disclaimers. If you do not accept them you must stop using the Website and must not place an order.
2. Advice
The content of this Website does not constitute professional, academic or legal advice and should not be relied upon in making, or refraining from making, any decision.
3. Changes to the Website and to these Terms
STEM Editor reserves the right to:
• change or remove (temporarily or permanently) the Website or any part of it without notice, and you confirm that STEM Editor shall not be liable to you for any such change or removal; and
• change these Terms and Conditions at any time. Material changes that affect ongoing or recently concluded contracts will be notified to you in advance (for example by email). Your continued use of the Website after any such changes constitutes acceptance of the revised terms.
4. Viruses and malware
While we employ reasonable antivirus measures and endeavour to ensure that files originating from this Website or from email correspondence with us are free of known computer viruses, we make no warranty that such files are virus-free. You are strongly encouraged to check all emails, attachments and other files before opening them. Any risk of virus contamination remains solely with the recipient.
5. Privacy Policy and data protection
We respect the privacy of your personal information. Our full Privacy Policy forms part of these Terms and Conditions and is available on the Website. Client documents containing personal data are processed solely for the performance of the proofreading/editing service (lawful basis: contract – Art. 6(1)(b) GDPR). You have the rights of access, rectification, erasure, restriction, objection, portability and the right to lodge a complaint with the AEPD as set out in the Privacy Policy.
Orders are submitted via a Jotform form. Payment is processed by PayPal (including credit/debit card payments handled by PayPal). STEM Editor does not store full card or bank details. Client documents are automatically deleted from our systems 15 days after the edited files are returned. Our freelance editors are also required to delete their local copies within that period. If you require your documents to be deleted in a shorter period than 15 days, please request this by email. All contract editors are bound by non-disclosure and confidentiality obligations. STEM Editor accepts no liability for an individual editor’s breach of those contractual obligations beyond the remedies available under consumer law.
6. Links to third-party websites
This Website may include links to third-party websites controlled and maintained by others (including Jotform and PayPal). Links do not constitute endorsements. We are not responsible for the content, availability or security of any third-party websites.
7. Copyright
7.1 All copyright, trademarks and other intellectual-property rights in this Website and its content (including design, text, graphics, software and source code) are owned by or licensed to STEM Editor or used as permitted by law.
7.2 In accessing this Website you agree to use the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder, except for downloading, copying or printing pages of this Website for personal, non-commercial home use only.
8. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, and without prejudice to your mandatory consumer rights under Spanish and EU law (including the TRLGDCU / LGDCU), this Website is provided on an “AS IS” and “AS AVAILABLE” basis without any representation or endorsement and without warranty of any kind, whether express or implied, including but not limited to implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security or accuracy.
To the extent permitted by law, STEM Editor will not be liable for any indirect or consequential loss or damage (including loss of business, opportunity, data or profits) arising out of or in connection with the use of this Website.
STEM Editor makes no warranty that the functionality of this Website will be uninterrupted or error-free, that defects will be corrected, or that this Website or the server that makes it available is free of viruses or anything else that may be harmful.
Nothing in these Terms and Conditions excludes or limits liability for death or personal injury arising from the negligence of STEM Editor or its employees or agents, or for any other liability that cannot be excluded or limited by law.
9. Indemnity
You agree to indemnify and hold STEM Editor and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses arising out of any claims or actions brought against STEM Editor as a result of your breach of these Terms and Conditions (for example by supplying plagiarised or infringing material).
10. Severance
If any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.
11. Governing law and jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Spain. If you are a consumer habitually resident in another EU/EEA Member State you benefit from any mandatory consumer protections afforded by the law of your country of residence that cannot be derogated from by agreement. Any disputes shall be subject to the non-exclusive jurisdiction of the competent courts in your place of residence or, at your choice, the Spanish courts.
12. Modification
We reserve the right to change any part of these Terms and Conditions. Your continued use of the Website after changes are posted constitutes acceptance of the revised terms. By purchasing services from STEM Editor you agree to these Terms and Conditions as in force at the time of the order.
13. Limited warranty on the editing service
To the maximum extent permitted by law and without prejudice to your statutory consumer rights, STEM Editor’s aim is to reduce the number of errors present in your text document. While we take reasonable measures to ensure the quality of our work, it is unlikely that every error can be removed. Our editors are human and therefore subject to human error. By ordering STEM Editor’s services you acknowledge that proofreading is a subjective undertaking and that our staff are capable of both forming and overlooking judgments. You accept sole responsibility for the use of any version of your proofread document for any purpose (for example publishing, submission or printing), including any financial, brand or other consequences of residual errors.
If the edited document does not conform to the agreed service standard you are entitled to the statutory remedies under consumer law, including re-editing (repair), a proportionate price reduction, or (in serious cases) termination of the contract and refund.
14. Limitation of liability
To the maximum extent permitted by applicable law and without prejudice to your mandatory consumer rights, in no circumstances will STEM Editor be liable for any indirect, special or consequential damages, including loss of business, revenue, customers or data, in relation to your use of this Website or any material returned by us. Nothing in these Terms and Conditions excludes liability for death or personal injury arising from the negligence of STEM Editor, its staff or agents.
If you are dissatisfied with any STEM Editor material or with any of these Terms and Conditions, your primary remedy is to discontinue using our services. Refunds or partial refunds may be offered in accordance with your statutory rights.
15. Academic liability
STEM Editor acknowledges that academic evaluation of work depends on considerations beyond our control. We cannot be held legally responsible for any disappointing or unsatisfactory academic outcomes, howsoever arising, including as a result of the negligence or alleged negligence of our editors or staff. This does not affect your rights regarding the quality of the proofreading service itself.
16. Use of the term “guarantee” or “guaranteed”
Use of the term “guarantee” or “guaranteed” on this Website or in communications with STEM Editor refers to our undertaking to deliver certain standards of service based on our own internal evaluations. Any such “guarantee” is without prejudice to your statutory remedies (re-performance, price reduction or refund).
17. Plagiarism and copyright infringement
It is your sole responsibility to ensure that the documents you supply to STEM Editor for editing are free from plagiarism and do not infringe any copyright, trademark, patent or other proprietary right of any third party. If STEM Editor identifies potentially plagiarised material it reserves the right to refuse services and to cancel any existing orders. STEM Editor assumes no liability for any claims made against you for plagiarism or infringement of third-party rights.
18. Purchases and payments
Orders are placed via the Jotform order form linked from the Website. When you submit an order, payment is authorised (but not yet captured) through PayPal (which also accepts major credit and debit cards). STEM Editor never receives or stores full card numbers or bank-account details. We aim to review and confirm acceptance of your order by email within 2 hours during business hours (every day, 08:00–18:00 UTC). Work does not commence until payment has been successfully captured. If the order is rejected, the payment authorisation is cancelled and no charge is made.
Completed work is returned electronically by email; no hard copies are posted. It is your responsibility to provide correct contact details so that we can return your work. We accept no liability for adverse consequences arising from incorrect contact details supplied by you.
Before completing any purchase, you will be provided with clear information on the total price (including Spanish IVA/VAT if applicable), the main characteristics of the service, and the estimated delivery time, in accordance with consumer-information requirements.
19. Order completion / delivery times
We reserve the right to extend the order deadline if the editor believes the document requires an above-average number of amendments that will need additional time. While we make every effort to meet stated turnaround times, circumstances beyond our control (technical failures, unexpected changes in an editor’s personal circumstances, etc.) may occasionally make this impossible. In ordering the service you acknowledge that, in rare cases, an order may be delivered later than the scheduled return time. In case of delay you may be entitled to remedies under applicable consumer law, including a proportionate price reduction where justified.
20. AI detection scores
STEM Editor does not guarantee any particular result in relation to AI-detection scores. AI-detection tools are widely regarded as unreliable and may produce inconsistent, inaccurate or contradictory results. Scores may vary between different tools and may fluctuate when the same text is submitted to the same tool on separate occasions. By ordering our services you acknowledge that AI-detection scores are beyond our control and that STEM Editor accepts no liability for any adverse consequences arising from any AI-detection score in relation to any document edited by us. This does not limit your rights concerning the actual quality of the proofreading service provided.
21. Refunds and complaints
Refunds and partial refunds are available in accordance with your statutory rights, including the right of withdrawal and remedies for non-conforming services.
If you are not entirely satisfied and can cite reasonable justifications, contact info@stemeditor.com detailing your complaint. A full or partial refund may be agreed provided you supply valid reasons for dissatisfaction. We reserve the right to take corrective action to address concerns before offering a refund. Any decision as to the nature or extent of corrective actions or refunds remains at our discretion, subject always to mandatory consumer law.
Complaints must be submitted as soon as practicable after the return of the edited files. Statutory limitation periods apply; we cannot evaluate complaints after files have been deleted in accordance with our security protocols.
22. Right of withdrawal (consumers)
As a consumer in the EU/EEA you have the right to withdraw from this distance contract within 14 calendar days without giving any reason and without incurring any costs other than those set out below. The withdrawal period begins on the day the contract is concluded.
To exercise the right you may use the model withdrawal form (available on request) or send an unequivocal statement to info@stemeditor.com.
If you request us to begin performance of the service before the 14-day period ends, you must give prior express consent and acknowledge that you will lose the right of withdrawal once the service has been fully performed. In such cases, if the service is only partially performed at the time of withdrawal, you will pay a proportionate amount for the work already completed.
We will reimburse any payments received within 14 days of receiving your withdrawal notice, using the same payment method.
Exceptions: the right of withdrawal does not apply where the service has been fully executed with your prior express consent and acknowledgment that you lose the right once performance is complete (TRLGDCU Art. 103 / Consumer Rights Directive Art. 16).
